User Agreement

Effective date: October 2, 2026

This User Agreement ("Agreement") is a contract between you and RoutineSpot LLC ("RoutineSpot," "we," "us," or "our"). It governs your access to and use of the RoutineSpot iOS application, our website, and related services (together, the "Services").

By creating an account, selecting an acceptance control, or using the Services, you agree to this Agreement and our Privacy Policy. If you do not agree, do not use the Services.

Apple's Standard EULA governs your license to the iOS app. This Agreement separately governs your RoutineSpot account and the Services.

RoutineSpot is currently offered only in the United States.

1. What RoutineSpot provides

RoutineSpot helps you create and manage private exercise and routine templates, record workouts, keep workout history, use rest timers, and use supported Siri, Shortcuts, and Spotlight features.

RoutineSpot does not currently charge a fee or offer in-app purchases. We will provide new terms and any disclosures required by law before introducing a paid feature.

We may add, change, suspend, or remove features. We do not promise that every feature will always be available or that the Services will work with every device, operating-system version, third-party service, or network.

2. Eligibility

The Services are intended for users who are at least 18 years old and are not available to children under 13. Users under the age of majority may use the Services only with the permission and direct supervision of a parent or legal guardian. Before you use the Services, your parent or legal guardian must read and agree to this Agreement on your behalf.

You may not use the Services if the law prohibits you from doing so or if we previously terminated your account for a serious or repeated violation of this Agreement.

The Services are intended for personal, noncommercial use in the United States.

3. Your account

You may create an account with an email address and password or with Sign in with Apple. You agree to provide accurate information and keep it current.

You are responsible for:

  • protecting your password, device, and account
  • activity performed through your account
  • notifying us promptly at support@routinespot.com if you suspect unauthorized access

Do not share your password or allow another person to use your account. We may require you to sign in again before sensitive actions, including account deletion.

4. Fitness and medical disclaimer

RoutineSpot is a fitness planning and recording tool. It is not a medical device or health-care service. The Services do not provide medical advice, diagnosis, treatment, physical therapy, personal training, or emergency services.

Exercise, weight training, and changes to an exercise program involve risks. These risks can include overexertion, equipment damage, serious injury, disability, and death. You are responsible for deciding whether an exercise, weight, repetition target, rest period, routine, or other activity is safe and appropriate for you.

Before starting or changing an exercise program, consult a qualified health-care professional when appropriate. Stop exercising and seek medical attention if you experience pain, faintness, chest discomfort, unusual shortness of breath, or another concerning symptom.

IF YOU HAVE A MEDICAL EMERGENCY, CALL 911.

You assume the risks of exercise and of relying on information stored or displayed through the Services.

5. Your content

"Your Content" means information you enter or save through the Services, including routine and exercise names, notes, workout plans, set values, and workout history.

You retain any rights you have in Your Content. You give us a limited, non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, and modify Your Content only as needed to:

  • provide, secure, maintain, and improve the Services
  • perform actions you request
  • comply with law
  • enforce this Agreement

This license ends when Your Content is deleted from our active systems, except where we must retain information for a limited legal, security, backup, or dispute-resolution purpose. Our Privacy Policy describes deletion and retention in more detail.

You represent that:

  • you own Your Content or have the rights needed to provide it
  • Your Content and your use of it do not violate law or another person's rights
  • you will not include another person's sensitive or confidential information without authorization

The Services are not a backup service. Keep any separate copy of Your Content that you need. We are not responsible for loss or corruption of Your Content except where applicable law does not allow that limitation.

6. Our content and your right to use the Services

The Services, including software, design, text, graphics, trademarks, and other materials that we provide, are owned by RoutineSpot or our licensors and are protected by law.

While you comply with this Agreement, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Services and our content for your personal, noncommercial use.

We reserve all rights not expressly granted to you.

7. Acceptable use

You may not:

  • use the Services for an unlawful, fraudulent, deceptive, or harmful purpose
  • access another person's account or data without authorization
  • submit malware, harmful code, or content designed to disrupt the Services
  • bypass authentication, App Check, product limits, quotas, or security controls
  • probe, scan, or test a system's vulnerability without our written permission
  • interfere with the Services or place an unreasonable load on them
  • use bots, scripts, scrapers, or other automated means to access the Services unless we authorize it
  • reverse engineer, decompile, disassemble, or try to derive source code, except to the extent law expressly permits
  • copy, sell, sublicense, rent, distribute, or commercially exploit the Services
  • use the Services or their output to build a competing product
  • submit content that infringes intellectual property, privacy, publicity, or other rights
  • impersonate another person or misrepresent your affiliation
  • use the Services to provide medical care, emergency monitoring, or a service regulated by HIPAA

We may investigate suspected misuse and take reasonable steps to protect the Services and users.

8. Third-party services

The Services rely on third parties, including Apple, Google Firebase, and Google Cloud. You use third-party services at your own risk. Third-party services are governed by their own terms and privacy policies. We do not control them and are not responsible for their independent acts, omissions, availability, accuracy, or content.

Siri, Shortcuts, Spotlight, Sign in with Apple, notifications, and other Apple features may require separate permissions or settings. RoutineSpot or the applicable provider may change, suspend, restrict, or discontinue an external service at any time, with or without notice, to the extent permitted by law. External services may not remain available in every location, language, operating-system version, or device.

9. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain information. It also explains your privacy choices and rights.

10. Feedback

If you send ideas, suggestions, or other feedback about the Services, you give us a worldwide, perpetual, irrevocable, royalty-free license to use and share that feedback for any purpose without payment or attribution. This section does not change how our Privacy Policy applies to personal information included in feedback.

11. Suspension and termination

You may stop using the Services at any time. You may delete your account from Settings in the app.

We may suspend or terminate access if:

  • you materially or repeatedly violate this Agreement
  • your use creates a security, legal, or safety risk
  • we must do so to comply with law
  • we discontinue the Services

When practical, we will give notice and a chance to correct the issue. We may act immediately when necessary to prevent harm, protect the Services, or comply with law.

After termination, your right to access and use the Services ends. Sections that by their nature should survive will survive, including sections about ownership, feedback, disclaimers, liability, indemnity, disputes, and general terms.

12. Service availability and changes

The Services may experience interruptions, delays, errors, or data loss. We may release updates that change app features or require a supported operating system.

We may update this Agreement. If a change is material, we will provide reasonable notice through the Services, by email, or by another method allowed by law. The updated Agreement will state its effective date. If you do not agree to an updated Agreement, you must stop using the Services and delete your account.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." ROUTINESPOT AND ITS SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT WORKOUT CONTENT, TIMERS, NOTIFICATIONS, HISTORY, OR OTHER INFORMATION WILL BE ACCURATE, COMPLETE, SAFE, RELIABLE, OR SUITABLE FOR YOU.

No oral or written information or advice from RoutineSpot or its authorized representatives creates a warranty.

Some states do not allow certain warranty disclaimers. In those states, this section applies only to the extent permitted by law.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTINESPOT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THIS INCLUDES LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, AND PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM EXERCISE OR RELIANCE ON THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ROUTINESPOT AND THE OTHER PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF:

  1. the amount you paid RoutineSpot for the Services in the 12 months before the event giving rise to the claim
  2. fifty U.S. dollars (US $50)

These limits apply under any theory of liability, even if we were told that damages were possible and even if a remedy fails its essential purpose.

Some states do not allow certain exclusions or limits. In those states, these limits apply only to the extent permitted by law. Nothing in this Agreement excludes liability that cannot lawfully be excluded.

15. Indemnity

To the extent permitted by law, you will indemnify and hold harmless RoutineSpot and its owners, officers, employees, and contractors from third-party claims, damages, losses, and reasonable legal costs arising from:

  • Your Content
  • your unlawful misuse of the Services
  • your material violation of this Agreement
  • your violation of another person's rights

This obligation does not apply to the extent a claim results from RoutineSpot's own negligence, willful misconduct, or violation of law. We may control the defense of an indemnified claim, and you agree to reasonably cooperate.

16. Governing law and disputes

Before filing a legal claim, you and RoutineSpot agree to make a good-faith effort to resolve the dispute informally. Send a written notice describing the dispute and requested resolution to support@routinespot.com. We will use the contact information associated with your account to send a notice to you. Either party may proceed after 30 days if the dispute is not resolved.

This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules. Except for a claim eligible for small claims court, any court proceeding must be brought in the state or federal courts located in Santa Clara County, California. You and RoutineSpot consent to personal jurisdiction and venue in those courts.

Nothing in this section prevents either party from seeking urgent injunctive relief to prevent unauthorized access, security abuse, or infringement of intellectual property. Nothing limits a right or remedy that applicable consumer law does not allow you to waive.

17. California consumer notice

Under California Civil Code section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Boulevard, Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.

You may contact RoutineSpot at the address listed in Section 19.

18. General terms

This Agreement and the Privacy Policy are the entire agreement between you and RoutineSpot about your account and the Services.

If a court finds part of this Agreement unenforceable, that part will be enforced to the maximum lawful extent or removed, and the rest will remain effective.

Our failure to enforce a provision is not a waiver. You may not assign this Agreement without our written consent. We may assign it in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to applicable law.

This Agreement does not create an employment, agency, partnership, joint venture, fiduciary, or franchise relationship.

Section headings are for convenience only. The word "including" means "including without limitation."
